Terms and Conditions


1. INTRODUCTION

eTopUpOnline (the “Company”) products are available for purchase through the eTopUpOnline eGift website, mobile applications and approved third party websites displaying the eTopUpOnline eGift icon. The use of the eTopUpOnline website, mobile applications and approved third party websites displaying eTopUpOnlines eGift icon are governed by our Terms (the “Terms”).

2. TERMS OF SERVICE

  • 2.1. Your purchase of any eTopUpOnline product constitutes an agreement (the “Agreement”) by and between you (“You, or “Your”) and the Company. The Agreement is governed by the Terms set forth herein. Purchase of a Vendor’s eGift Card is governed by the applicable terms and conditions of the eGift Card provider. The eTopUpOnline Terms will cease to apply at the time of such purchase.
  • 2.2. By purchasing the products and/or clicking “Accept”, you agree to be bound by these Terms. The Company reserves the right, at its sole discretion, to change, modify, add or remove all or part of the Terms and conditions of this Agreement at any time, and such amended terms and conditions shall be incorporated herein and effective immediately. The Company shall provide notification of any such changes by posting such changes on the Company website and updating the “Last Updated” date at the top of the Terms. The Company encourages You to review these Terms each time you make a purchase from eTopUpOnline to ensure Your understanding of the Terms. Continued use of and access to the site after any such notice shall constitute consent to the Terms.
  • 2.3. The Company offers a variety of eGift Cards and gift codes (collectively, “eGift Cards”) for purchase via its websites, mobile applications or approved third party websites displaying eTopUpOnline eGift icon, deliverable to recipients via text messaging. The Company accepts various forms of payment, including credit or debit card bearing Visa, MasterCard, American Express, or Discover logo, PayPal (each, a “Payment Card”). All eGift Cards are subject to availability and we reserve the right to impose quantity limits on any order, to reject all or any part of an order and to discontinue products without notice. The total/aggregate amount that can be loaded on one or more eGift Cards in a single day cannot exceed $200 USD. Purchase of any eGift Card will incur a load fee of up to USD $7.95 and will appear as a one-time charge on Your bank or credit card statement. After purchasing an eGift Card, you (or the recipient of the eGift Card) must activate the eGift Card then redeem by following the instructions provided by the Product provider and defined at the back of each card. The eGift Card will only function upon activation. These Terms will no longer apply after activation occurs.   • 2.4. eGift Cards purchased via the Company website, mobile application or approved third party websites displaying eTopUpOnline eGift icon are issued by participating third-party merchants, retailers and vendors (collectively “Vendors”) and are governed by terms and conditions established by the issuing Vendor. Depending on the applicable law of your jurisdiction and the promotional nature of certain eGift Cards, Vendors may set expiration dates for eGift Cards, please refer to Vendor terms and conditions for more information. The Company strongly recommends You review and familiarize yourself with all applicable Vendor terms and conditions prior to making a purchase. Please direct any and all questions regarding the applicable Vendor terms to the appropriate issuing Vendor. Issuing Vendors (and not the Company) are fully responsible for all aspects of their eGift Card programs. You hereby agree that the Company is therefore not responsible for any and all liabilities, damages and costs suffered by You or any other Party in connection with your purchase and use of the products and You thereby hold eGift Cards.
  • 2.5. While the Company strives to work with reputable Vendors, it has no liability for (i) the sale of products or services to you by a Vendor through the use of any eGift Card; and (ii) any Vendor’s failure to honor a eGift Card. You will need to look solely to the Vendor for any remedy in connection with the foregoing issues. eGift Card Errors. We attempt to be as accurate as possible and to eliminate errors on the products that we sale; however, eTopUpOnline does not represent or warrant that any eGift Card and information about the eGift Card (including the description, Vendor information or pricing information) provided is accurate, complete, reliable, current or error-free. In the event of an error, in an order confirmation, in processing a eGift Card purchase or otherwise, we reserve the right to correct such error and revise your order accordingly (including charging the correct price) or canceling the order and refunding any amount charged.

3. DISCLAIMERS

  • 3.1. In addition to the disclaimers, limits on liability and indemnification obligations set forth in the Terms of Service, which apply to these Terms and are incorporated herein by this reference, you waive and release the Company and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any liabilities, damages and costs arising from or related to (i) your loss or the theft of any eTopUpOnline product (including eGift Cards); and (ii) any act or omission of a Vendor in connection with a eGift Cards. The Company is therefore not responsible for replacing damaged or lost products.
  • 3.2. With respect to the products available for purchase. The title for such products passed to You when you complete your purchase. The Company is not responsible for any damage or loss resulting from stolen or lost products (including eGift Cards) or any use without your permission.
  • 3.3. The Company and its licensees, affiliates, and licensors make no warranties, express or implied, with respect to the products sold, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose.
  • 3.4. Subject to the monetary caps described above, the products offered are transferrable within the USA, Canada and the UK; however, CANNOT be resold to any third party or parties. These disclaimers and limitations may or may not apply to you and are void where prohibited.

4. PAYMENTS

The Company accepts various forms of payment including but not limited to Visa, MasterCard, American Express, Discover and PayPal. Unless otherwise indicated, the denominated value of the eGift Card will be billed in full at the time you purchase along with all applicable fees. By making the purchase, You acknowledge that You are authorized to use the designated Payment Card and You authorize the Company to charge Your purchase order to that Payment Card. When you provide your payment information, you authorize us to process and store your payment and related information. In the event that the Payment Card you designate cannot be verified, is invalid or is not otherwise acceptable, we may suspend or cancel your order automatically. Payment Card processing fees may apply even if the Payment Card has expired or changed by the time The Company submits the charges.

5. APPLICABLE TAXES

With respect to the eGift Cards that you purchase on the website, mobile applications or approved third party websites displaying from eTopUpOnline, the amount paid for any eGift Card does not include sales, value added or use taxes, which may be charged to you separately by the applicable Vendor at the time you purchase products or services from the Vendor using the eGift Card.

6. CANCELLATIONS; NO RETURNS

All purchases made on the Company website, mobile applications or approved third party websites displaying eTopUpOnline eGift icon are final. eGift Cards are non-returnable and non- refundable. The Company, at its sole discretion, reserves the right, to replace, refund or exchange any defective purchase. 7. LIMITATION OF LIABILITY

The Company bears no responsibility for use of the Applications and/or Services in connection with any unauthorised, illegal, fraudulent, immoral or indecent activity. The Company, its directors, employees, officers or agents exclude all liability and responsibility for any loss or damage that may result, including without limitation any direct, indirect, incidental, special, or consequential, exemplary or punitive loss or damage or any loss of income, money, data or goodwill arising out of or in connection with Your purchase or use of the Products or Services being offered. No damages other than compensatory damages, strictly limited to the total value paid in relation to the products and Services provided, where fault lies solely with the Company, shall be incurred by the Company. No right of indemnity exists for You or any third party against the Company. To the fullest extent permitted by law, The Company makes no warranties in relation to the use and availability of Products, Applications or Services provided.

8. PRIVACY

The Company will comply with all of its obligations under applicable data protection laws with regard to relevant data in its possession relating to You.

9. SEVERABILITY

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

10. WAIVER

Enforcement of the Terms is solely in our discretion and our failure to enforce a provision in some instances does not constitute a waiver of our right to enforce such provision in other instances.
